These terms cover how you and your workspace use Varity. Plain English, fair defaults, and the same posture we'd want as customers ourselves.
You need a Varity account to use the product. You are responsible for keeping your credentials safe, for any teammates you invite, and for the accuracy of the information you put into your workspace.
We offer free, paid, and agency plans. Each plan has its own limits (workspaces, seats, AI credits, queued jobs); we list them at /pricing and update them with notice.
Everything you create or upload to Varity — drafts, brand assets, media, analytics — is yours. You grant us a non-exclusive, worldwide license to host, display, and process that content only as needed to provide the service to you and the people you authorize.
We do not claim ownership over your content. We do not use it to train any model, ours or a third party's.
You agree not to use Varity to:
Paid plans renew monthly or annually depending on what you select. We bill in advance for the upcoming period. You can cancel any time from /settings/billing — cancellation takes effect at the end of the current period and there are no cancellation fees.
If a charge fails, we'll retry your card. Your account stays open so you can update billing on /settings/billing and pick a plan again. We never delete your content for non-payment.
Varity publishes to third-party platforms on your behalf using the credentials you connect. Those platforms have their own terms; we cannot guarantee uptime, rate limits, or feature availability for any of them.
If a platform suspends or rate-limits your account, that is between you and the platform — we'll show you the diagnostic log so you know why.
We target 99.9% monthly uptime for the application and 99.5% for the publish/automation worker pool. SLA credits are available on Agency and Enterprise plans (see your order form).
We may run maintenance windows; we announce them at least 48 hours in advance for anything that takes the service offline.
You can delete your workspace at any time. We can terminate or suspend an account that materially breaches these terms — we'll give you written notice and a chance to cure unless the breach is one we can't reasonably wait on (security, legal, abuse).
Varity is provided as-is. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability is capped at the fees you paid us in the 12 months before the claim.
Nothing in these terms limits liability for fraud, willful misconduct, or anything else that can't be limited under applicable law.
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes that can't be resolved informally go to binding arbitration in Wilmington, DE; either party may bring small-claims actions in their home jurisdiction.
If we make a material change to these terms, we'll notify you by email at least 30 days before it takes effect. Continued use after the effective date counts as acceptance.
